Consultation & Assessment Waiver

This Consultation & Assessment Waiver (“Waiver”) governs the free, one-time in-person or virtual dog-training consultation (“Consultation”) offered by The Dogfather Corp(“The Dogfather”, “we”, “our”, or “us”). By checking the acknowledgment box and typing your name as a signature when booking a Consultation, you (“the Client”) agree to be bound by this Waiver. If you do not agree, do not book or attend a Consultation.
1. Nature of the Consultation
The Consultation is a one-time, no-obligation 45-minute initial conversation and observation conducted in person (commonly at Brooks Rd Park, 51 Keeler Blvd, Scarborough ON) or virtually. It is not a training session or a formal behaviour and training evaluation, and no specific outcome or behavioural change is promised as a result of attending.
The 45-minute Consultation is free. If a separate formal behaviour and training evaluation is needed, its $50 CAD fee will be disclosed before booking and credited toward an enrolled program.
2. Eligibility & Owner Authority
By signing, the Client confirms they are at least 18 years of age and are the legal owner of the dog, or an authorized representative of the legal owner with full authority to bind the owner to this Waiver.
3. Accuracy of Disclosures
The Client warrants that all information provided at booking — including bite history, prior refusals of service by other trainers, boarders, daycares, or veterinarians, vaccination status, and behavioural concerns — is complete and truthful. The Dogfather relies on these disclosures to plan a safe Consultation. Undisclosed bite history or aggression is a material breach of this Waiver and may result in the Consultation being refused or ended on arrival without liability to The Dogfather.
4. Assumption of Risk
The Client acknowledges that working with dogs — including unfamiliar dogs, dogs with behavioural concerns, or dogs in a new environment — carries inherent risks that cannot be fully eliminated, including but not limited to:
- Bites, scratches, or other physical injury to the Client, the dog, or third parties
- The dog reacting unpredictably to a new person, environment, or handling technique
- Escape, slipped-collar, or off-leash incidents during the assessment
- Aggravation of an undisclosed or pre-existing behavioural or medical condition
The Client voluntarily assumes full responsibility for these inherent risks, provided The Dogfather has not acted with gross negligence or willful misconduct.
5. Dog Owner Liability (Ontario Dog Owners' Liability Act)
The Client acknowledges that under the Dog Owners’ Liability Act, R.S.O. 1990, c. D.16, the owner of a dog is strictly liable for damages resulting from a bite or attack by the dog, regardless of any prior history. The Client remains solely responsible for their dog’s conduct toward The Dogfather, other attendees, and the public during the Consultation.
6. Release of Liability
The Client confirms they have had the opportunity to seek independent legal advice before signing.
7. Indemnification
The Client agrees to indemnify, defend, and hold harmless the Released Parties from any and all claims, lawsuits, damages, losses, and costs (including legal fees) arising from any bite, attack, injury, or property damage caused by the Client’s dog during or in connection with the Consultation, or from any material misrepresentation made when booking.
8. Limitation of Liability
To the maximum extent permitted by law, the Released Parties’ total aggregate liability arising from or related to the Consultation shall not exceed the fee actually paid for the Consultation (which is $0 for the free 45-minute Consultation). This limitation does not apply to liability that cannot lawfully be limited, including liability for gross negligence or willful misconduct.
9. No Guarantee of Results
The Consultation is a diagnostic assessment only. The Dogfather makes no representation or guarantee regarding the dog’s future behaviour, trainability, or the outcome of any program subsequently recommended or purchased. Training results depend substantially on consistent owner follow-through, which is outside The Dogfather’s control.
10. Handling Requirements
The Client agrees the dog will arrive on a flat (non-restrictive) collar and a leash no longer than 6 feet. Harnesses, flexi/retractable leashes, and off-leash arrival are not permitted, as they interfere with a safe assessment. The Dogfather may decline to proceed with the Consultation if the dog arrives without proper handling equipment, without it counting as a cancellation by The Dogfather.
11. Media Consent (Optional)
Where the Client has separately opted in at booking, the Client grants The Dogfather a royalty-free license to use anonymized photos or video of the dog from the Consultation for social media and marketing (Instagram @thedogfather___, dogfather.ca, and related channels). This consent is optional, separate from the rest of this Waiver, and revocable in writing at any time by contacting thedogfathercorp@gmail.com.
12. Governing Law & Dispute Resolution
This Waiver is governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Any dispute arising from or related to this Waiver is subject to the exclusive jurisdiction of the courts of the City of Toronto, Ontario. The parties agree to attempt good-faith negotiation before initiating formal legal proceedings, and either party may pursue resolution through the Ontario Small Claims Court (for disputes under $35,000) or the Superior Court of Justice, as applicable.
13. Electronic Signature
By checking the acknowledgment box and typing your full legal name at booking, you are providing a legally binding electronic signature. Electronic signatures are valid and enforceable in Ontario under the Electronic Commerce Act, 2000, S.O. 2000, c. 17. Your IP address and a timestamp are captured alongside your signature for legal record.
14. Entire Agreement & Severability
This Waiver constitutes the entire agreement between the parties regarding the Consultation and supersedes any prior discussions on the subject. If any provision is found invalid or unenforceable, that provision is severed and the remainder stays in full force. This Waiver does not replace, and is separate from, the Boarding Service Agreement signed for any subsequent paid program.
